My husband is a CNA but had a felony about 6 years ago. I need advice.?

My husband had the felony a long time ago. He did his employment screening and now he is frustrated because they might terminate his employment. They said he should file an exemtion with the health department. He has been going to school for over a year for rn and its been like a waste of time if he cant work now. Does anybody know the process that one goes through to file the exemption? Is there court and a lengthy time involved?My husband is a CNA but had a felony about 6 years ago. I need advice.?
depending on your state and the conviction charge getting his record expunged is the only way out of this, depending on the state this could be as simple as filling out a form and paying a fee to appearing in court,, if he is in school and has had a clean record, got married, has kids, can't get a job because of the conviction the court will usually expunge the record if he has been a model citizen.. no matter the length of time it takes don't give up and continue on with the schooling! good luck!My husband is a CNA but had a felony about 6 years ago. The Board of Nursing in NO state will issue a license to a convicted felon.





End of story.





You CANNOT get a felony expunged...that is the difference between felony's and misdemeanors...misdemeanors get expunged, felony's get pardoned.





His best hope is to contact a STATE Senator and see if he can get a pardon from the governor of that state. Since it has been six year, and your husband has made substantial improvements to his life, he would be an excellent candidate.





The Board of Nursing is the ONLY AUTHORIZED entity that can answer your husband's question and here is the catch.....they will usually refuse to commit to an answer until you apply to take the NCLEX-RN.

That is how it works.





There is no such thing as an exemption...the BON controls it all.
They should have checked hist background before they hired him, and before he got into the nursing program they should have his background check. If he has pr oven he has become a better person and hasn't gotten into any trouble since his conviction, he can get an exemption from the state.
